Substantially overturned by the Supreme Court in Hopcraft and another v Close Brothers Ltd; Johnson v FirstRand Bank Ltd (London Branch) (trading as MotoNovo Finance); Wrench v FirstRand Bank Ltd (London Branch) (trading as MotoNovo Finance) [2025] UKSC 33. The Supreme Court held that motor dealers do not owe disinterested-duty fiduciary obligations to consumers and rejected the wider bribery basis of liability, leaving liability narrowly intact only where the relationship is unfair under s.140A Consumer Credit Act 1974.
