1. The Appellant appealed against the decision of the Respondent dated 17 November 2023 to remove his name from the Register of Approved Driving Instructors pursuant to section 128 (2) (e) of the Road Traffic Act 1988 . 2. The Respondent has indicated in an email dated 15 November 2024 that the Respondent does not oppose the appeal following the acquittal of the Appellant of the criminal charge forming the basis on which the decision under appeal was made. 3. I find that the Appellant was acquitted at the Crown Court at Gloucester on 10 July 2024 and, accordingly, I find there were no grounds to remove the Appellant from the Register of Approved Driving Instructors. 4. I am satisfied that this appeal can be properly determined without a hearing in accordance with the wishes of the parties pursuant to rule 32 of The Tribunal Procedure (First-tier Tribunal)(General Regulatory Chamber) Rules 2009.
